Effective as of: January 19, 2009
This Privacy Policy governs and regulates the collection and use of information that Lacar,
LLC (hereinafter the “Company”) with legal domicile at 2295 Gateway Oaks Drive, Suite 185,
Sacramento, CA 95833, United States, makes available to Internet users through the website
www.ombai.com (hereinafter the “Site”). By using our Site you are consenting to our processing
of your personal information as set forth in this Privacy Policy now and as amended by us.
“Processing” means using cookies on a computer or using or touching information in any way,
including, but not limited to, collecting, storing, deleting, using, combining and disclosing
information. We advise you to read this policy carefully and to send us any questions to
http://www.ombai.com/ContactUs/ContactUs.aspx?mailTo=legal.
If you do not agree with this Privacy Policy, please do not use our Site or provide us with

INFORMATION COLLECTED
Unregistered users
The general use of the Site does not require the user’s prior subscription or registration.
Unregistered users are entitled to access and surf the Site without providing any personal
information. Information collected from unregistered users is limited. Said information
does not give us access to the identity of unregistered users and shall be used to help
diagnose any possible problems with our server, manage the Site, and track usage statistics.
Even though when you visit the Site our servers automatically record information, such as your
IP address, the Company does not attempt to identify the user through the user’s IP, regardless
of the connection used. Our objective is to obtain general statistics about user preferences in
order to improve the Site’s services. To that effect, like many other websites, we use “cookie”
technology to collect additional website usage data and to improve the Site. A cookie is a small
data file that we transfer to your computer’s hard disk. Through the use of cookies we collect
information that may indicate if the user has accessed our Site through an advertisement or link
from another website, but this does not give us access to the identity of the unregistered users
in question. Most Internet browsers automatically accept cookies. You can instruct your browser,
by editing its options, to stop accepting cookies or to prompt you before accepting a cookie from
the websites you visit.
Registered Providers and Members
Therapists that register completing the form available at:
http://www.ombai.com/Accounts/CreateAccount.aspx (“Providers”)
shall be able to create public profiles providing users with information about their
therapeutic services. Users that register completing the form available at:
http://www.ombai.com/Accounts/CreateUserAccount.aspx(“Members”)
shall be able to create public profiles enabling them to comment on therapeutic services
they have received, and to communicate with the online community on the Site.
In the case of Providers, we collect not only the information described in the paragraphs
above, but also personal information included in the registration form. This form requires
the following information: username, password, e-mail, name, last name, date of birth,
location (country and city), and areas of expertise. All this information- excepting
password - shall be included on the Provider’s public profile. In the case of Members,
the registration form requires the following personal information: username, password, e-mail,
last name, date of birth, and location (country and city). All optional information the Provider
or Member may voluntarily fill out shall also appear on the public profile. Providers and Members
should only fill out the optional information that they wish to share with those visitors of the
Site who decide to view their profiles. Providers and Members who wish to share their usernames
only should abstain from including any optional information. The Company does not collect user
information from any other source, such as public records or private organizations.
Our Site allows Providers and Members to communicate with other users and publish information
that shall be available to others. The Provider or Member should be aware that when doing so,
other users may collect information about him or her.
Upon logging in, Providers and Members shall have the option of having their username and
password stored in a cookie on their computer hard drive. This option allows the system to
show user preferences when accessing the Site and customize the Site, without requiring users
to log in every time they visit same.
If you are a Provider or Member, you may, at any time, review, update, correct or delete
the personal information in your registration profile. If you completely delete any such
information, then your account may become deactivated. If you would like us to delete or
correct certain data about you in our system, please contact us to
http://www.ombai.com/ContactUs/ContactUs.aspx?mailTo=legal and we will accommodate your
request as reasonably practical. Note however that we may need to retain an archived copy of
your records as required by law or for legitimate business purposes. Comments or other
information previously posted on the Site shall not be erased.
USE OF INFORMATION COLLECTED
When the user provides information, this information is stored in a highly secure server to
maintain information confidentiality. To improve security, passwords undergo special treatment,
and are encrypted. Information shall be used for general statistics purposes, and also in order
to provide users with a more customized, higher-quality service. Information provided shall also
be used by us to send information by e-mail regarding relevant issues. Personal information
provided by Providers or Members shall not be used for any other purpose not expressed herein.
Any other use of personal information provided shall require the prior consent of the
Providers or Members in question.
DISCLOSURE OF PERSONAL INFORMATION
The Company does not share personal information stored in its database with third parties,
nor does it sell nor rent same. If the involvement of another company is required for market
research or any other particular purpose, said company shall only have access to general
information that would not reveal the identity of users.
The Company cooperates with government and law enforcement officials and private parties
to enforce and comply with the law. We will disclose any information about you to government
or law enforcement officials or private parties as we, in our sole discretion, believe
necessary or appropriate to respond to claims and legal processes (including but not limited
to subpoenas), to protect the property and rights of the Company or a third party, to protect
the safety of the public or any person, or to prevent or stop activity we may consider to be,
or to pose a risk of being, any illegal, unethical or legally actionable activity.
Finally, the Company may transfer registered users’ personal information to any affiliates as
well as in connection with a merger, acquisition, reorganization or sale of all or substantially
all of the assets of the Company. [We will notify you before transferring your information if
the new entity's processing of your information will materially differ from that set forth in
this Privacy Policy.]
PROTECTION OF PERSONAL INFORMATION
We are very concerned with safeguarding your information. In order to help protect personal
information stored in the servers used by the Site from unauthorized users, the Company has
taken a series of security measures. E-mails or any other communications to Providers or
Members shall be sent in accordance with their preferences. Except as otherwise provided
in this Privacy Policy, we do not access registered Providers’ or Members’ information unless
in exceptional circumstances or acts of God, and we maintain user confidentiality. We also
implement the following data protection measures: password hashing, login auditing,
and idle session termination.
We will make any legally required disclosures of any breach of the security or confidentiality
of your unencrypted electronically stored personal information to you via email or conspicuous
posting on the Site in the most expedient time possible and without unreasonable delay, insofar
as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary
to determine the scope of the breach and restore the reasonable integrity of the data system.
INTERNATIONAL TRANSFER
Your information may be transferred to — and maintained on — computers located outside of your
state, province, country or other governmental jurisdiction where the privacy laws may not be
as protective as those in your jurisdiction. Your consent to this Privacy Policy followed by
your submission of such information represents your agreement to that transfer.
LINKS TO OTHER SITES
The Site contains links to other websites. If you choose to visit an advertiser by clicking
on a banner ad or other type of advertisement, or click on another third party link, you
will be directed to that third party’s website. The fact that we link to a website or present
a banner ad or other type of advertisement is not an endorsement, authorization, or representation
of our affiliation with that third party, nor is it an endorsement of their privacy or
information security policies or practices. We do not exercise control over third party websites.
These other websites may place their own cookies or other files on your computer, collect data or
solicit personal information from you. Other sites follow different rules regarding the use or
disclosure of the personal information you submit to them. We encourage you to read the privacy
policies or statements of the other websites you visit.
CHILDREN’S PRIVACY
Our system was designed considering the protection of child privacy. By verifying date of birth
we prevent children under 18 from publishing information on the Site or registering to same.
Notwithstanding the aforementioned, considering that there are no reliable technologies available
that may allow the Company to ensure that information provided by the user is true and accurate
(age in particular), the Company suggests that parents or legal guardians of children under 13
supervise and advise their children or wards regarding Internet use and explain to them that they
are prohibited from accessing websites such as this, where users must be over the age of 13.
The Company further invites parents or guardians of children under 13 to take the necessary
precautions so that said minors do not have access to this Site (for example,
by applying filters to websites).
The Company is particularly careful about the protection of minors and teens. If you are a
parent or guardian of a minor or teen and believe the content in this Site to be
inappropriate for your child or ward or that the use of this Site could expose your
child or ward to certain risks, such as participation in virtual forums with strangers,
please take the necessary precautions so that said minor or teen does not have access
to this Site (for example, by applying filters to websites). It is of paramount importance
that parents or guardians of minors or teens supervise and counsel their children or wards
regarding their use of Internet. If you have accessed this Site while trying to find out
which websites your child or ward visits and do not wish for your child or ward to continue
accessing this Site, please take the necessary precautions to block your child or ward’s
access to this Site (for example, by applying filters to websites). The Company shall
intervene in any situation that puts a minor or teen at risk, including but not limited to,
any breach of privacy of said minor or teen, upon knowledge of same. However, as it is often
impossible to control all user activities in websites, parents or guardians must also
cooperate to prevent these types of risks.
CHANGES TO THE PRIVACY POLICY
The Company reserves the right to change this Privacy Policy at its sole discretion and/or
when required for legal reasons. Users must read the Privacy Policy when accessing the Site
to be notified of any changes that may occur. We will notify you of any material changes to
our Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes.
By continuing to access or use the Site after we have notified you of the changes, you agree
to be bound by such changes.
